PROPOSED MINUTES
SPEICIAL COUNCIL MEETING OF SEPTEMBER 27, 2007


Elkins City Council met in special session in the council chamber of city hall at 6:15 p.m. Thursday, September 27, 2007. Present were Mayor Judith A. Guye; Councilpersons: R. N. Beckwith, J. S. Bibey, V. T. Broughton, H. K. Burford, T. Z. Hensil, R. J. Malcolm, C. L. Metheny, I. D. Talbott, K. L. Wilmoth and R. A. Woolwine; City Clerk P. J. Graziani, Jr., City Treasurer L. L. Crosston, City Attorney R. T. Busch, Police Lieutenant H. R. White, II and Fire Chief T. W. Meader. Police Captain J. E. Batdorf was absent.

Cm Metheny, seconded by Cm Woolwine, MOVED THAT COUNCIL ACCEPT THE MINUTES OF THE REGULAR MEETING OF SEPTEMBER 20, 2007 AS PRESENTED. The motion carried.


UNFINISHED BUSINESS


Cm Talbott, seconded by Cm Broughton, MOVED THAT PROPOSED ORDINANCE 067, AUTHORIZING ISSUANCE OF WATERWORKS SYSTEM DESIGN BOND ANTICIPATION NOTES, SERIES 2007, BE BROUGHT FORTH, READ BY TITLE ONLY AND PASSED ON SECOND READING. The motion carried. [The measure would provide for a line of credit not to exceed $1,950,000 with Davis Trust Company to pay, among other costs, the professional engineering fees necessary for the design of a new water treatment plant and modifications and replacements to the water transmission and distribution system.]


NEW BUSINESS

Cm Beckwith, seconded by Cm Hensil, MOVED THAT HALLOWEEN TRICK OR TREAT BE OBSERVED ON WEDNESDAY, OCTOBER 31 BETWEEN THE HOURS OF 5:30 AND 7:00 P.M. FOR CHILDREN 12 YEARS OF AGE AND YOUNGER. The motion carried.

Cm Hensil, seconded by Cm Malcolm, MOVED THAT COUNCIL GRANT THE REQUEST OF THE CHURCH OF GOD & FAMILY WORSHIP CENTER TO TEMPORARILY CLOSE 14TH STREET BETWEEN TAYLOR AND LIVINGSTON AVENUES ON OCTOBER 30 AND 31 DURING ITS 15TH ANNUAL HALLELUJAH HARVEST CELEBRATION. The motion carried.

Cw Wilmoth, seconded by Cm Bibey, MOVED THAT COUNCIL APPROVE THE EMPLOYEE TRAVEL REFLECTED ON THE AGENDA. The motion carried. [The two municipal judges will attend mandatory municipal court training in Charleston.]

Cm Talbott, seconded by Cm Hensil, MOVED COUNCIL AUTHORIZE THE MAYOR TO EXECUTE A PROFESSIONAL SERVICES CONTRACT WITH CHAPMAN TECHNICAL GROUP FOR ENGINEERING DESIGN OF A NEW WATER TREATMENT PLANT AND TRANSMISSION LINE IMPROVEMENTS AND REPLACEMENTS. The motion carried.

In response to a protest filed by Leadsville Public Service District, the West Virginia Public Service Commission instituted Case No. 07-1831-W-MA, an investigation and suspension of increase in water rates and charges, in accordance with West Virginia Code §24-2-4b.


COMMITTEE REPORTS

BUILDING

Permit Application 3296 remained partially considered. The Committee received 12 building permit applications since the last meeting of council, 3457 thru 3468. Acting upon recommendation of the building inspector, the Committee approved all applications.

LANDFILL

John Simmons, injured scale house operator, visited the landfill, saying his recovery was progressing.

WV DEP approved methodology proposed for a program to sample the waters of the Tygart Valley River downstream of the landfill. Sampling could provide information for DEP to determine if there are circumstances that would allow landfill leachate to be introduced directly into the river.


WATER

The project to replace water mainlines on Davis Avenue was nearing completion.

Deterioration of Filter No. 4 at the water treatment plant may be more widespread than originally thought. Visual indications were that the concrete underlying the filter may also be badly deteriorated. The concrete underlying the filter form part of the clear well. The structural engineer will inspect the project on October 1.

The possibility of temporarily closing a portion of Barron Avenue was mentioned. The area in question, between 11th and Wilcox Streets, would, if closed, allow for the storage of construction-related materials closer to the street.

Operational personnel reported on the Cleveland, OH training seminar, saying it gave good insight into established standards for system modeling.
RULES AND ORDINANCE

Cw Burford said Committee members met with citizen members of an ad hoc committee originally formed to prepare recommendations for an ordinance to regulate cats. The meeting was productive, and a proposal should soon be ready.

The measure proposed to increase the rate of Hotel Occupancy Tax was briefly discussed. All speakers spoke positively of the measure. Cm Beckwith said he was proud of the proactive stance that he and his fellow council members had taken. The extra tax funds to be generated from travelers would provide additional funds for community improvement. The hope was expressed that Randolph county commissioners would follow the city’s lead and increase the rate of Hotel Occupancy Tax in unincorporated areas. Cm Hensil noted that the legislature had only recently enacted enabling legislation allowing for municipal increases in the tax rate.


STREETS

In response to a question, Cm Hensil stated that only the portion of Vernon Avenue lying within the city limit had been paved.

Cm Beckwith requested a copy of the list of streets paved this year.


OTHER BUSINESS

Cm Broughton said he had sold his house on 11th Street, in Fifth Ward, and intended to move to the top of Wilson Street, in Second Ward. He then announced his intention to resign his office as soon as the move was completed, a period of 4-8 weeks. He then commended his fellow council members, saying they communicated well with one another. Having realized completion of the sidewalk on 11th Street, between Delaware Avenue and the Kroger parking lot, he said his only remaining project was establishment of a skatepark.

The mayor said Vision 2010 committee members recently met to report on the status of various undertakings.

The Historic Landmarks Commission intends to present a design guideline proposal for council’s consideration, Cm Talbott said.

Walgreens did not offer the former Davis house to the city prior to its demolition.

The traffic light at Harrison Avenue and Lough Street had been replaced. Timing of the light changes has been regulated, and it seems to be working well.

The WV Department of Highways will consider a recommendation from the historic landmarks commission for decorative traffic signal poles.
