PROPOSED MINUTES
REGULAR COUNCIL MEETING OF MAY 3, 2007



Elkins City Council met in special session in the council chamber of city hall at 7:04 p.m. Thursday, May 3, 2007. Present were Mayor Judith A. Guye; Councilpersons: R. N. Beckwith, V. T. Broughton, J. S. Bibey, H. K. Burford, T. Z. Hensil, R. J. Malcolm, C. L. Metheny, I. D. Talbott and R. A. Woolwine; City Clerk P. J. Graziani, Jr., City Treasurer L. L. Crosston, Police Captain J. E. Batdorf, City Attorney R. T. Busch, and Fire Chief T. W. Meader. Councilwoman K. L. Wilmoth was absent.

PUBLIC COMMENT

Buckhannon resident and city street commissioner, Pat Long spoke in support of skate parks, saying he had been instrumental in the initiative to found a skatepark there. He said their facility attracted youth and lessened graffiti and vandalism in other parts of the city. Additionally, infractions of skateboarding restrictions were reduced to zero. Having worked with the city’s insurer to satisfy its underwriting concerns, the premium rates were not excessive. No accidents have been reported. Operating during specified hours, the facility did not require adult supervision. He said he believed the facility was an asset to the downtown area.

Alice Sabatino, 405 Kerens Avenue, said Y.E.S., the group of youth and adults trying to establish a skatepark in Elkins, was asking the city to make land available for the skatepark. The organization itself would raise the money necessary to establish the skateboarding infrastructure.

O. Hope Jerrio, 172 High Street, said crime should be punished, citing the example of former New York mayor Rudy Giuliani. She also said police should not be rude, and they should treat everybody with respect.

Robert McLaughlin, 110 Whisperwood Drive, complained that residents of his street don’t receive the same service for the sanitation fee they pay as other city residents. He said Whisperwood Drive residents had to transport their solid waste to a collection point [near the intersection of Whisperwood Drive and Andrews Street.] Whisperwood Drive is a private road, not a city street; therefore, sanitation trucks won’t traverse it. He complained that water trucks would use the drive to read meters, and other city crews would use the drive to mow near Flood Control Road.

Roy Teter, 119 Southgate Road, supported the use of city land for a skateboard park.

Cm Metheny, seconded by Cm Broughton, MOVED THAT COUNCIL ACCEPT THE MINUTES OF THE SPECIAL MEETING OF APRIL 17, 2007 AS PRESENTED. The motion carried.


UNFINISHED BUSINESS

Attorney Busch reviewed his proposal for final order to be signed by Judge Henning in the matter of Mary’s Greenhouse v. City of Elkins, Civil Action 05-C-102. The plaintiff would have 30 days after the effective date of a final order to appeal the decision.



NEW BUSINESS

Cm Beckwith, seconded by Cm Hensil, MOVED THAT COUNCIL GRANT THE REQUEST OF KIPLING SHOE COMPANY TO CONDUCT AN ANNUAL SIDEWALK SALE. The motion carried.

Cm Metheny, seconded by Cm Broughton, MOVED THAT COUNCIL GRANT THE REQUEST OF THE RANDOLPH COUNTY CANCER SUPPORT GROUP TO CONDUCT A 5K WALK AND 5 MILE RUN. The motion carried.

Cm Woolwine, seconded by Cm Hensil, MOVED THAT COUNCIL GRANT THE REQUEST OF GIRLS ON THE RUN OF RANDOLPH COUNTY TO CONDUCT A 5K RACE. The motion carried.

Cm Beckwith, seconded by Cm Broughton, MOVED COUNCIL APPROVE EMPLOYEE TRAVEL REFLECTED ON THE AGENDA. The motion carried. [Two water fund employees will travel to Ripley, WV for backflow recertification.]

Cm Talbott, seconded by Cm Hensil, MOVED THAT COUNCIL AUTHORIZE THE MAYOR TO EXECUTE A POTABLE WATER MUTUAL ASSISTANCE AGREEMENT. The motion carried.

Cm Talbott, seconded by Cm Hensil, MOVED COUNCIL AUTHORIZE THE MAYOR TO EXECUTE ALL DOCUMENTATION NECESSARY TO EFFECT THE REPAIR OF WATER TREATMENT PLANT FILTER NO. 4 BASED UPON THE MOST COST EFFECTIVE METHOD. The motion carried.


COMMITTEE REPORTS

BUILDING

The Committee received 21 building permit applications since the last meeting of council, 3260 thru 3281. Permit Application 3274 was void. Acting upon recommendation of the building inspector, the Committee disapproved Application 3260. The construction proposed would have encroached upon the 5-foot setback requirement, a violation of zoning law. All other applications were approved. Cm Malcolm, seconded by Cm Talbott, MOVED THAT COUNCIL GRANT THE 20 PERMIT APPLICATIONS APPROVED BY THE COMMITTEE. The motion carried.

PUBLIC SAFETY

A vacancy exists in an entry-level position in the police department. The Policemen’s Civil Service Commission will administer a written test on June 9.


MUNICIPAL PROPERTY

An organizational meeting was held to inform new members of the status of ongoing projects (i.e., the Baxter Street garage modifications and improvements, potential sites for a skatepark, etc.)




WATER

The water mainline will be replaced on Davis Avenue between 5th and 6th Streets.

David Bodkin commenced a probationary period of employment in the transmission and distribution department.
