PROPOSED MINUTES
REGULAR COUNCIL MEETING OF APRIL 5, 2007



Elkins City Council met in regular session in the council chamber of city hall at 7:04 p.m. Thursday, April 5, 2007. Present were: Mayor Judith Ann Guye; Councilpersons: R. N. Beckwith, V. T. Broughton, J. S. Bibey, H. K. Burford, T. Z. Hensil, R. J. Malcolm, C. L. Metheny, K. L. Wilmoth and R. A. Woolwine; City Clerk P. J. Graziani, Jr., City Treasurer L. L. Crosston, City Attorney R. T. Busch, Police Captain J. E. Batdorf and Fire Chief T. W. Meader. Councilman I. D. Talbott was absent.


AGENDA ADJUSTMENTS

There were none.


PUBLIC COMMENT

Betty Cox, 102 Sunset Drive, complained of property damage caused by free-roaming cats. She asked that regulation be enacted.

Reverend Douglas Lewis, River Street, expressed concern about the accessibility of a deserted house recently acquired by the Randolph County Housing Authority.

Jacob Bell, a preteen 2nd Street resident, asked for a safe place to practice and develop his skateboarding skills.

Linda McCauley, 2nd Street resident, spoke in favor of a publicly funded skatepark.

INFORMATIONAL PRESENTATION

Ryan Biller acquainted council members with recent accomplishments and future plans of the Youth Empowered Solutions (YES!) group. Formed to realize construction of a public skateboard park and associated recreation center, the group has demonstrated an ability, he said, to work with other community organizations to achieve its goals and raise funds, either directly or as granted by other organizations. Besides providing recreational opportunities in the form of a skatepark, the group also visualizes a pro shop and equipment rental/repair facility, to provide entrepreneurship training opportunities for the youth involved. In closing, Mr. Biller said, “The major component for the success of our youth’s endeavor is an appropriate piece of property. The lot behind city hall is public, protected and accessible to the market on which this concept depends. It is ideal! The Vision 2010 study has pointed us to just such a project. We would appreciate your support for this important component of Youth Empowered Solutions.”

Joseph Sabatino, 405 Kerens Avenue, said he supported the comments made by Mr. Biller.


CONSENT CALENDAR

Cm Metheny, seconded by Cm Broughton, MOVED THAT COUNCIL ACCEPT THE MINUTES OF THE CERTIFICATION OF THE MUNICIPAL GENERAL ELECTION OF MARCH 6, 2007; THE REGULAR MEETING OF MARCH 15, 2007; AND THE SPECIAL CALL MEETING OF MARCH 27, 2007 AS PRESENTED. The motion carried.


UNFINISHED BUSINESS

No action was taken on Proposed Ordinance 061, amending Breach of Peach legislation was not considered, pending public notification.

Cm Hensil, seconded by Cm Broughton, MOVED THAT PROPOSED ORDINANCE 062, TRANSFERRING DIAMOND STREET PROPERTY BETWEEN DORSEY HECKLER AND CITY OF ELKINS, BE BROUGHT FORTH, READ BY TITLE ONLY AND PASSED ON SECOND AND FINAL READING. The motion carried.


NEW BUSINESS

Patrolman Jeffery D. Roy will have completed his probationary period of employment on April 14, 2007, and Captain Batdorf has recommended him for permanent status. Cm Bibey, seconded by Cm Metheny, MOVED THAT COUNCIL GRANT PERMANENT EMPLOYMENT STATUS TO PATROLMAN JEFFERY D. ROY EFFECTIVE APRIL 14, 2007. The motion carried.

Patrolman Bradley T. Sharp will have completed his probationary period of employment on April 17, 2007, and Captain Batdorf has recommended him for permanent status. Cm Metheny, seconded by Cm Bibey, MOVED THAT COUNCIL GRANT PERMANENT EMPLOYMENT STATUS TO PATROLMAN BRADLEY T. SHARP EFFECTIVE APRIL 17, 2007. The motion carried.


Cm Bibey, seconded by Cm Malcolm, MOVED THAT COUNCIL ADOPT PROPOSED RESOLUTION 079, AUTHORIZING APPLICATION FOR GRANT FUNDING TO OBTAIN A POLICE CRUISER SURVEILLANCE CAMERA. The motion carried.

Cm Beckwith, seconded by Cm Malcolm, MOVED THAT COUNCIL ADOPT PROPOSED RESOLUTION 080, AUTHORIZING THE MAYOR TO EXECUTE PAPERWORK NECESSARY TO MAKE APPLICATION FOR ENFORCING THE UNDERAGE DRINKING LAWS GRANT PROGRAM FUNDING. The motion carried.

Cm Woolwine, seconded by Cm Broughton, MOVED THAT COUNCIL ADOPT PROPOSED RESOLUTION 081, AUTHORIZING THE MAYOR TO EXECUTE PAPERWORK NECESSARY TO MAKE APPLICATION FOR EMERGENCY SHELTERS GRANT PROGRAM FUNDING FOR THE USE OF THE RANDOLPH COUNTY HOMELESS SHELTER. The motion carried.

Cw Burford, seconded by Cm Broughton, MOVED THAT COUNCIL ADOPT PROPOSED RESOLUTION 082, AUTHORIZING THE MAYOR TO EXECUTE PAPERWORK NECESSARY TO MAKE APPLICATION FOR EMERGENCY SHELTERS GRANT PROGRAM FUNDING FOR THE USE OF WOMEN’S AID IN CRISIS. The motion carried.


COMMITTEE REPORTS

BUILDING

The Committee received 32 building permit applications since the last meeting of council, 3218 thru 3249; however, consideration of applications 3234 and 3235 was deferred, pending a review and recommendation of the city attorney. Acting upon recommendation of the building inspector, the Committee approved all other applications; however, permit 3248 will be held pending receipt of a contractor license and payment of the appropriate fee.

WATER

A river cleanup will take place on April 21.

Chapman Engineering will make an informational presentation at the meeting of May 19.


PARKS

Construction has commenced on the Lower Glendale Bottom pedestrian bridge to Riverbend Park.

The family of William J. and Brenda Brown donated an existing log house to the Elkins Parks and Recreation Commission. The structure will be moved to Lower Glendale Bottom, where it will serve as an office for the Commission’s operational personnel.


PERSONNEL

Cw Wilmoth provided each member with a copy of the financial terms for the city attorney’s current one-year term.


STREETS

Street sweeper operations have begun; however, no tickets for violation of restrictions will be issued until May.


Cm Metheny, seconded by Cm Woolwine, MOVED COUNCIL ENTER EXECUTIVE SESSION FOR CONSIDERATION OF A PERSONNEL MATTER. The motion carried.

Council entered executive session at 7:34 p.m.
Council resumed regular session at 7:48 p.m.

The mayor said no actions had been taken, nor had any decisions been made.


OTHER BUSINESS

Mary’s Greenhouse v. City of Elkins will be argued in Randolph County Circuit Court at 8:30 a.m. on April 18.

The Vision 2010 Ad Hoc Committee will soon begin to meet.

Heather Biola has been instrumental in the formation of a Tree Committee. The Committee will commence an inventory of trees in the city.

A general city cleanup effort has been scheduled for May 7.
