PROPOSED MINUTES
REGULAR COUNCIL MEETING OF JULY 21, 2005
Elkins City Council met in regular session in the council chamber of city hall at 6:58 p.m. Thursday, July 21, 2005. Present were: Mayor Judith Ann Guye; Councilpersons: R. N. Beckwith, J. S. Bibey, V. T. Broughton, T. P. Ditty, H. R. Elbon, T. Z. Hensil, R. J. Malcolm, C. L. Metheny, K. L. Wilmoth and R. A. Woolwine; Deputy City Clerk A. L. Broschart; City Treasurer L. L. Crosston; City Attorney J. E. Busch; Police Lieutenant H. R. White and Fire Chief T. W. Meader. City Clerk P. J. Graziani, Jr., City Attorney R. T. Busch and Police Captain J. E. Batdorf were absent.
AGENDA ADJUSTMENTS
1. Proposed ordinance 033, incorporating the streets within Brigdewater Estates into the City limits.
2. Proposed ordinance 034, making it an offense and providing for penalties for failure to obey any sign officially posted by City of Elkins.
PUBLIC COMMENT
Dr. Farukh Khan expressed numerous concerns about the future site of the DHHR and DMV building project located on the Parsons Road. He proposed the Railroad Yard would be a better location.
Renee Jensen said she had concerns about the understaffing of the police department and police protection within the city. She stated that the abandoned houses in the area require the Citys attention and asked who owned the abandoned house on 107 Graham Street. She also expressed that the paving of Sylvester Drive should not be at the expense of the City.
Alfred Varner stated that the City of Elkins would not incur any cost associated with the Sylvester Drive paving project. The property owners will fund the project.
Robert Beckwith stated he did not own the house on 107 Graham Street.
Dave Rao, 909_ S. Henry Avenue, again voiced his belief that the 2003 municipal general election was illegal.
Van Broughton said the City Attorney did not contact the Secretary of States Office in reference to the 2003 election as promised.
CONSENT CALENDAR
Cm Elbon, seconded by Cm Hensil, MOVED THAT COUNCIL ACCEPT THE AMENDED MINUTES OF THE REGULAR MEETING OF JULY 07, 2005 AS PRESENTED. (The minutes should reflect that K. Wilmoth was absent from the meeting.) The motion carried.
UNFINISHED BUSINESS
Cm Hensil, seconded by Cm Metheny, MOVED THAT PROPOSED ORDINANCE 032, TO PAVE SYLVESTER DRIVE, FROM ITS INCEPTION ON SCOTT FORD ROAD TO ITS TERMINUS AT ALEXANDER AVENUE, BE BROUGHT FORTH, READ BY TITLE ONLY AND PASSED ON SECOND AND FINAL READING. The motion carried.
NEW BUSINESS
Cm Bibey, seconded by Cm Broughton, MOVED COUNCIL ADOPT PROPOSED RESOLUTION R-48, DESIGNATING THE NATIONAL INCIDENT MANAGEMENT SYSTEM AS THE BASIS FOR ALL INCIDENT MANAGEMENT IN THE CITY OF ELKINS. The motion carried
Cm Metheny, seconded by Cm Beckwith, MOVED COUNCIL ADOPT PROPOSED RESOLUTION R-049, AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT WITH THE WEST VIRGINIA DEPARTMENT OF FINANCE AND ADMINISTRATION TO OBTAIN LOCAL ECONOMIC DEVELOPMENT ASSISTANCE GRANT PORGRAM FUNDS FOR THE USE OF THE ELKINS-RANDOLPH PUBLIC LIBRARY. The motion carried.
Cm Metheny, seconded by Cm Broughton, MOVED COUNCIL ADOPT PROPOSED RESOLUTION R-50, AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT WITH THE WEST VIRGINIA DEPARTMENT OF FINANCE AND ADMINISTRATION TO OBTAIN LOCAL ECONOMIC DEVELOPMENT ASSISTANCE GRANT PROGRAM FUNDS FOR THE USE OF THE ELKINS-RANDOLPH COUNTY YMCA. The motion carried.
Cm Woolwine, seconded by Cm Bibey, MOVED THAT COUNCIL ACCEPT THE APPOINTMENT OF GARY PAINTER TO THE ELKINS, WV POLICEMENS CIVIL SERVICE COMMISSION. The motion carried.
Cm Elbon, seconded by Cm Broughton, MOVED THAT COUNCIL APPROVE THE REQUEST OF THE KIPLING SHOE COMPANY TO UNDERTAKE A SIDEWALK TENT SALE. The motion carried.
Cm Beckwith, seconded by Cm Woolwine, MOVED COUNCIL APPROVE THE TRAVEL REQUEST FOR TWO STREET DEPARTMENT EMPLOYEES TO FAIRMONT FOR A 3 DAY BACKHOE TRAINING SEMINAR. The motion carried.
Cw Wilmoth, seconded by Cm Bibey, MOVED COUNCIL APPROVE THE REQUEST OF THE ELKINS-RANDOLPH COUNTY CHAMBER OF COMMERCE TO BLOCK PORTIONS OF RAILROAD AVENUE ON FRIDAY, AUGUST 26 FOR THE 2ND ANNUAL SPRING FLING. The motion carried.
Cm Wooline, seconded by Cm Elbon, MOVED THAT PROPOSED ORDINANCE 033, INCORPORATING THOSE CERTAIN STREETS COMMONLY KNOWN AS BRIDGEWATER ESTATES INTO THE CITY LIMITS, BE BROUGHT FORTH, READ BY TITLE ONLY, AND PASSED ON FIRST READING. The motion carried.
Cm Metheny, seconded by Cm Malcolm, MOVED THAT PROPOSED ORDINANCE 034, AMENDING CHAPTER 13 TO ADD ARTICLE 1, SECTION 13-6.2 OF THE CITY CODE, MAKING IT AN OFFENSE TO FAIL TO OBEY ANY SIGN OFFICIALLY POSTED BY THE CITY OF ELKINS AND PROVIDING PENALTIES THEREFOR, BE BROUGHT FORTH, READ BY TITLE ONLY, AND PASSED ON FIRST READING. The motion carried.
COMMITTEE REPORTS
BUILDING
The Committee received 14 building permit applications since the last meeting of council, 2765 to 2778. Acting upon recommendation of the building inspector, the Committee approved 14 applications.
Cm Malcolm, seconded by Cm Hensil, MOVED THAT COUNCIL GRANT THE 14 PERMIT APPLICATIONS APPROVED BY THE COMMITTEE. The motion carried.
PUBLIC SAFETY
Cm Bibey reported the committee is working on proposed budget realignments for the police department. He also said the list of eligible applicants from the Policemens Civil Service Commission has been exhausted and the process for a new list needs to be completed before the new enrollment period begins at the training academy. The committee is working on a proposal for a full time fire chief and new rank structure for the fire department.
SANITATION AND LANDFILL
A meeting will be scheduled with the Finance and Municipal Properties committee to discuss the acquisition of a new building for the department.
STREETS
The paving on Sycamore Street will be completed on July 22, 2005.
WATER
The Committee approved travel for 3 employees to Knoxville, Tennessee on August 2-3 to visit a micro filtration plant. W. C. Weil Company will pay for all expenses incurred.
OTHER BUSINESS
The City picnic is scheduled on August 7th at the City Park.
